Terms of Service
Effective Date: October 6, 2026
1. Introduction
Welcome to NightBook. These Terms of Service ("Terms") govern your access to and use of the platform operated by NightBook AI, LLC ("NightBook", "we", "us") — our website, the NightBook desktop and mobile apps, and the NightBook agent that answers messages on your behalf (collectively, the "Service"). By creating an account or using the Service, you agree to be bound by these Terms.
2. Messaging Channels
NightBook sends and receives messages on your behalf, through the channels you connect to your account. Today those are Telegram, iMessage and text messages (both through the NightBook relay app running on your own Mac, with your own iPhone paired for texts), email, the NightBook Chat link you share with clients, and — with the Mac app — the Web Inbox Robot, which answers the message inboxes of booking sites you sign it into. WhatsApp, Instagram and Facebook Messenger are waiting for Meta's approval and are not available yet. Every conversation also appears in your NightBook inbox, where you can answer it yourself. Messages may include:
- Appointment confirmations and reminders
- Booking, cancellation, and rescheduling notifications
- AI-generated responses to client inquiries
- Follow-up messages and general client communication
NightBook is not an SMS provider. We have no SMS carrier or aggregator, sell no phone numbers, and bill nothing per message. Text messages work only through your own Mac and your own iPhone, on your own carrier plan. Every message travels over a channel you connected, under that channel's own terms — Telegram's, Apple's, your carrier's, your email provider's — and NightBook does not change or override them.
3. Your Responsibility for Client Messaging
You decide who your NightBook agent talks to. You are responsible for having the right to message each client you bring into NightBook, and for complying with the laws and the channel rules that apply to that contact. NightBook is the tool; the relationship with your client is yours.
Message frequency depends on your appointment activity and on how much your clients write in. Any charges from your own messaging channel or carrier are between you and them — NightBook does not bill for messages.
4. Turning the Agent Off
You are in control of whether NightBook answers at all:
- Choose Semi-autonomous and NightBook drafts replies for you to send, edit, or dismiss instead of sending them itself
- Disconnect any channel at any time from the channel strip in Messages, and NightBook stops using it
- Delete your account, which stops everything (see the Privacy Policy, section 7)
When a client replies STOP (or a similar word) on any channel, NightBook confirms once and stops sending them automated messages; START turns them back on. Messages you write yourself are not blocked, so honoring a client’s wish not to be contacted is still your responsibility. Clients can also block or mute you through the messaging app they are using, which is outside our control.
5. When Your Agent Starts
Creating an account costs nothing and needs no card. You can set up your profile, your services and your availability, connect your channels, and look around the dashboard without paying us anything. What a plan buys is the agent itself: your agent begins answering your clients when a plan is active, and not before. No usage is included ahead of that, and nothing is charged until you choose a plan.
6. Eligibility
You must be at least 18 years old to use NightBook. By using the Service, you represent that you are at least 18 years of age and have the legal capacity to enter into these Terms.
You may not use NightBook if you are located in, or ordinarily resident in, a country or region under comprehensive U.S. sanctions, or if you appear on a U.S. government list of restricted parties.
7. User Accounts
You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized use of your account. NightBook is not liable for any loss arising from unauthorized access to your account.
8. Subscription & Billing
NightBook offers three managed plans: Plus at $29/month, Pro at $99/month, and Max at $199/month. Each plan can be paid yearly instead, at ten monthly payments for the year — two months free. Plans differ by how much monthly usage they include; usage resets each calendar month on every plan, and we never charge beyond the plan's price without your explicit purchase.
By subscribing, you authorize us to charge your payment method on a recurring basis for the interval you chose. You may cancel at any time through the Billing page in your dashboard; cancellation takes effect at the end of your current billing period. Payments are processed by Stripe.
Refunds. If NightBook isn't right for you, email support@nightbook.ai within 7 days of your first payment and we'll refund it in full. After that, payments are non-refundable except where the law requires otherwise.
9. AI-Powered Features
NightBook uses artificial intelligence to generate responses to client messages, suggest appointment times, and automate routine communication. AI-generated responses will not always be right. You are responsible for reviewing and managing how your agent behaves — the Agent page in your dashboard is where you teach it, review what it has learned, and choose whether it replies to clients directly or drafts for your review. By default NightBook chooses and pays for the AI models behind the Service and may change them at any time. See the Privacy Policy, section 4, for where message processing happens.
AI processing. To write replies, NightBook sends message content to the AI vendors listed in our Privacy Policy. We instruct them not to use it to train their models, and we never sell it.
Not medical advice. NightBook is scheduling and messaging software. It does not provide medical, health or other professional advice, and your agent is not a substitute for your own judgment. Questions about a client's health or safety are yours to answer.
10. Acceptable Use
You agree not to:
- Use the Service for spam, harassment, or illegal purposes
- Send messages that violate applicable laws or regulations
- Attempt to access other users' accounts or data
- Reverse engineer or interfere with the Service's operation
- Offer, arrange or advertise adult or sexual services of any kind, including sexual or erotic massage and escort services
- Use your agent to write, request or send sexual content
- Sell or arrange anything that is illegal where you or your clients are
- Send marketing messages to people who haven't agreed to receive them
- Use your agent to deceive clients, including claiming it is a person when they ask
Your agent will not help anyone commit a crime; section 11 describes how it handles such requests.
We may suspend or close an account that breaks these rules.
11. How NightBook Protects You and Your Clients
NightBook is built with the protections below. They are safeguards, not guarantees: AI-generated responses will not always be right (§9), and you remain responsible for your account and your client relationships (§3).
- Illegal requests. Your agent is built to refuse requests for anything illegal — eighteen kinds, including drugs, weapons, fraud, scams, stalking and sexual services (see §10). A request it cannot clear waits for your review instead of being answered.
- Threats and harassment. A message that reads like a threat, stalking or sexual harassment is never answered automatically. Your agent sends nothing, you are alerted, and the conversation waits for you to decide whether anyone replies. NightBook does not contact anyone on your behalf.
- Your prices and policies. A reply that would promise a discount, refund, free session, waived fee or exception you did not set waits for your OK before it is sent. What a client claims you agreed to never becomes a rule or a fact your agent acts on.
- Crisis messages. A message that shows a crisis gets a safety response first and goes straight to you.
- Honesty about what it is. When a client asks whether they are talking to a person, your agent says plainly that it is an AI answering for you. It never claims to be human.
- Opting out. Clients can stop automated messages by replying STOP on any channel, as §4 describes.
- A review-first switch. If something looks wrong, NightBook can switch every account to review-first: while it is on, every reply your agent writes waits for your OK and automatic messages pause. Crisis responses, your own messages and STOP confirmations still go out.
- Your data. Messages, client notes and your agent's memories are encrypted when stored. Your data is backed up daily, with point-in-time recovery for the database. We never sell it, and we instruct our AI vendors not to train on it (§9).
- One client at a time. Each client has their own daily reply budget and a share of your plan's monthly usage, so one client cannot use up your month or silence your agent for everyone else. A client who goes past it, or whose messages look automated, stops getting automatic replies until you decide; a client who never books may first get one polite line inviting them to book. No AI is used on a held message.
- Scams aimed at you. A message that looks like a scam aimed at you — a payment trick, a suspicious link, someone pretending to be NightBook or another company, or questions fishing for your private details — gets no automatic reply and is marked in the conversation; suspicious links are crossed out and are never opened. A new client asking for more than two upcoming bookings needs your OK.
- Your call. You decide with one card in your Review Queue: keep replying, pause replies, or block. Pause and Block are also in every conversation's menu, and a client who sends three suspicious messages within a month is muted automatically until you unmute them.
12. Limitation of Liability
NightBook is provided "as is" without warranties of any kind. We are not liable for any indirect, incidental, or consequential damages arising from your use of the Service, including missed appointments, lost revenue, or communication errors.
13. Modifications
We may update these Terms from time to time. We will notify you of material changes via email or through the Service. Your continued use of NightBook after changes take effect constitutes acceptance of the updated Terms.
14. Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Service shall be brought exclusively in the state or federal courts located in New Castle County, Delaware, and you consent to the personal jurisdiction of those courts. Nothing in this section limits either party's right to seek injunctive relief in any court of competent jurisdiction.
